Bodily Injury

Bodily injury provides coverage if you cause bodily injury to the individual you are conducting the test on or if you cause bodily injury to the individual representing the company or organization that your are providing services to.

Property Damage

If you damage the property of the individual you are conducting the test on or if you damage the property of the company or organization that your are providing services to, you’re covered.

Please note that this coverage does not cover your physical business equipment, property or stock. If you require coverage for business equipment, property or stock, you must purchase a separate policy.

Personal Injury: Advertising

This provides coverage if, as a result of your advertising, you cause quantifiable damage to a third party.

A possible scenario where this coverage might be applicable is as follows:

You advertise to potential clients that you can complete a certain number of tests in a certain period of time. The client contracts for your services on that basis and you fail to complete the number of tests in the time specified. As a result of your failure to complete the tests as advertised, the client loses valuable potential employees to a competitor and the related revenues those employees might have brought in and sues you. This coverage will protect you from this type of lawsuit.

Medical Payments

This provides coverage if you volunteer to pay for medical assistance for an individual who is injured while you’re providing your drug and alcohol testing services.

An example of this might be if you call an ambulance for an individual and the charges for the ambulance are billed to you.

Tenant’s Legal Liability

This provides coverage if you are temporarily set-up at a client’s premises to conduct drug and alcohol testing and you cause physical injury to, or you damage the property of, an individual in the area where your are conducting your tests.

An example of a scenario where this coverage might apply is as follows:

An individual trips on the electrical cord of an appliance that you might have plugged in or slips and falls on something you might have spilled.

This coverage differs from the commercial general liability: bodily injury & property damage coverage because it pays for claims arising from changes you have made to the physical work environment as opposed to your immediate action that led to the individual’s injury.

Separation of Insured’s Cross-liability

If you sue or are sued by another DATAC member, the policy provisions apply to you separately.

Contractual Liability

This provides coverage if you are sued as a result of a breach of contract.

For example; if you are unable and/or unwilling to provide your services as specified in a written and/or verbal contract and the other party sues you as a result, in this instance, contractual liability provides coverage.

Errors and Omissions

This provides coverage for professional errors you make that result in a quantifiable loss to the individual you are testing and/or other individuals or entities.

An example of this might be if you were to contaminate, or mix-up, a specimen that was sent to a testing facility that results in an incorrect positive test result for an individual. As a result, the individual is terminated or suspended from employment or denied employment.

This coverage provides you with a legal defence and claim settlement against any legal claim brought by the individual in this scenario.
